I hear there’s a list of some special waters. How does that work,
and will it affect me?
The Act 118 statute changes included a new term – “area of special
natural resource interest”,
abbreviated ASNRI. The statute designates three categories of
waters as ASNRIs, and authorizes
DNR to add waters that have significant scientific value to the
list, through a public hearing process.
Under the statute, exemptions are not allowed in these
specially-designated waters, to ensure that
possible harmful impacts can be addressed through a DNR permit
review. A second new term –
“public rights features” – is established in another rule called
NR 1. Public rights features (PRF) are
specific locations of critical habitat in waterways, such as
Sensitive Areas identified in formal DNR
studies. The Stakeholder Group’s proposed rules allow existing
piers to be exempt in ASNRI waters
or locations of PRFs, since these are new terms and designations.
New piers in these areas will
require a general or individual permit to protect the special
features of these waters.
